# PeakPact Elite — Terms of Service **Effective date:** 15 September 2026 **Operator:** PeakPact **Contact:** legal@peakpactelite.app By accessing PeakPact Elite (mobile, web, or API), you agree to these Terms. ## 1. The service PeakPact Elite is a discipline operating system offering trials, verification/proof submission, squad ladders, quests, automation prompts, and AI coaching assist. Features may evolve. We may modify, suspend, or discontinue features with reasonable notice where practicable. ## 2. Eligibility You must be legally able to enter a binding agreement in your jurisdiction. If you are under the age of majority, you may use the Service only with parental/guardian consent where required. The Service is not directed to children under 13. ## 3. Accounts You are responsible for credentials and activity under your account. Authenticate via Clerk-backed flows. Do not share accounts or attempt unauthorized access. We may suspend accounts for fraud, abuse, or Terms violations. ## 4. Acceptable use You agree not to: - Upload unlawful, harmful, or infringing content - Submit fabricated verification intended to defraud squads or rankings - Harass, threaten, or exploit other users - Reverse engineer, overload, or bypass security controls except as allowed by law - Use AI outputs to generate prohibited content or medical/legal/financial advice claims ## 5. User content and verification media You retain ownership of content you upload. You grant PeakPact a worldwide, non-exclusive license to host, process, display, and transmit that content solely to operate Elite features (including R2 storage and Worker processing). You represent you have rights to submit the content. ## 6. AI features AI coaching/automation messages are generated or templated assistive content. They are **not** medical, mental-health, legal, or financial advice. You remain responsible for your actions. See AI Usage Disclosure and Responsible AI Policy. ## 7. Subscriptions and trials Paid entitlements may be offered via App Store, Google Play, or other billing partners. Store terms govern billing, refunds, and cancellation for in-app purchases. Trial features may expire or convert per the offer presented at purchase. ## 8. Intellectual property PeakPact Elite branding, software, and non-user content are owned by PeakPact or licensors. No rights are granted except as needed to use the Service. ## 9. Disclaimers THE SERVICE IS PROVIDED “AS IS” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS. ## 10. Limitation of liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAKPACT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/DATA. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. CONSUMER RIGHTS THAT CANNOT BE WAIVED REMAIN UNAFFECTED. ## 11. Indemnity You will defend and indemnify PeakPact against claims arising from your content, misuse of the Service, or violation of these Terms, except to the extent caused by our willful misconduct. ## 12. Governing law and disputes These Terms are governed by the laws of Romania, without regard to conflict-of-law rules, except where mandatory consumer protections of your habitual residence apply. Courts of competent jurisdiction in Romania shall hear disputes, subject to mandatory local venue rights for consumers. ## 13. Changes We may update these Terms.
